MANAGEMENT
The owner appoints Chic Property Management Limited (herein called “Chic”) to act as exclusive agent upon the terms herein provided for the renting, tenanting and managing of the property and agree to pay the charges as detailed herein until the agreement is terminated in writing by either party upon giving one months’ written notice.
AUTHORITY
Chic is authorised to: advertise for and select tenants; sign Tenancy Agreements for the property or any part thereof; record the owners name on any Tenancy Agreement; collect all rents due including any arrears; issue receipts for monies collected; exercise the Landlords right to terminate tenancies; serve notices upon tenants; issue notice to terminate tenancy; take such action against the tenants and all such things necessary to commence and obtain an order for possession or an order to terminate the tenancy from the Tribunal and any appeal arising there from; conduct rent reviews 6 monthly, set rents after evaluating market rents with consideration to maximising quality tenant retention; represent owner interests and liaise on the owner’s behalf with any insurance company; request redirection of water rates to Chic as agent; allocate debt collectors from time to time to pursue outstanding monetary orders on instruction from the property owner.
ADVERTISING
Chic is authorised to advertise the availability for rental of the premises, to display “To Let” signs, to complete credit checks and to charge these expenses to the owner.
BOND
Chic is authorised to collect the bond from each tenant and pay the same to Tenancy Services Division, Ministry of Business Innovation and Employment (MBIE) within 23 working days of receipt and to initiate refunds to the tenant upon Chic’s judgement on satisfactory completion of the tenancy. Where necessary to lodge claims against bond money under the rules of the Residential Tenancies Act 1986.
LETTING
At the end of each tenancy or in the event of a vacancy Chic is to contact the owner and arrange the letting of the property. Chic is authorised to advertise the availability for rental of the premises and prepare and distribute promotional material and credit check prospective tenants. Chic is authorised to charge a letting fee direct to the tenant which is equal to 1 week’s rent plus GST. On occasion should the Owner request the tenant not pay a letting fee the Owner agrees the letting fee be charged to the owners account.
PROFESSIONAL CLEANING
The owner shall pay for professional cleaners at the end of each tenancy if such is required (initially all appropriate measures shall be taken to recover these costs from the previous tenant).
BUILDING CODE
The Owner hereby informs Chic that their properties meet the current New Zealand Building Code.
HEALTH & SAFETY
The Owner agrees to maintain the property within the Health & Safety regulations and to allow or conduct necessary maintenance.
SMOKE ALARMS
The Owner shall ensure there is at-least one working unexpired smoke alarm within 3 metres of the entrance to any bedroom at the time of Chic taking on the responsibility of managing the property, or it is agreed Chic shall organise the supply and installation of long-life smoke alarm/s (at the Owners cost) to the property in accordance with Health and Safety regulations.
AGENT INDEMNITY
The owner shall hold and keep Chic indemnified against all actions suits proceedings claims demands costs and expenses whatsoever which may be taken or made against Chic in the course of or arising out of the property performance or exercise of any of the powers duties or authorities of Chic herein. Chic shall use its best endeavours to ensure continuity of occupation at market rentals and maintenance of the property, but shall not be liable to the owner/s for any defaults in payment of rent or any damage caused to the property by any tenant or other payment due by the tenant or otherwise, whether or not the tenancy has been arranged by Chic. Chic shall not be responsible for any injury to persons and or damage to the property arising out of the condition of, or any hazard in or about the property. The owner undertakes to ensure the property and chattels are adequately insured.
EXPENSES
Chic is hereby authorised to pay all property related expenses provided that Chic hold sufficient funds to my/our credit. Where no monies are held I/we agree to reimburse Chic within 5 working days. I/we authorise Chic to appoint a debt collection agency to pursue outstanding debts from tenants. I/we authorise you to pay all associated fees on my/our behalf.
Chic reserves the right to hold back a reserve amount from rent payouts from time to time to meet your expenses coming due
and/or to postpone maintenance until owner funds are available. Payment for land rates will be quarterly with all other payments
paid by due date of invoice.
KEYS
The owner agrees to supply Chic with a minimum of 2 full sets of keys for the property on commencement of this agreement.
REPAIRS
Chic is authorised to arrange and supervise any repairs or alterations on the said property, to purchase supplies and to
pay all accounts therefore. Chic agrees to secure prior approval of the owner on all expenditure exceeding $400+GST for any one
event. Repairs in an emergency situation to protect the property or to protect the health and safety of the tenant shall not require
my/our approval. Repairs ordered by the Tenancy Tribunal shall not require my/our approval. Chic does not accept liability for any
damage or loss caused by contractors organised to complete any work at the tenancy premises.
SCHEDULE OF FEES
Chic is hereby authorised to deduct commission charges and fixed charges for the management of this property
set at $3.61 per week per property plus 6.95% if unfurnished or 8.70% if furnished of all money collected from the tenant
(excluding bond & letting fee). Services include (a) Organising marketing of your property and completing tenant selection checks;
(b) Rent collection and management of any rent or other arrears; (c) Entry, 4-6 weeks after entry, exit and 3 routine inspections
per annum; (d) Handling of rates, water and insurance bills; (e) Attendance at Tenancy Tribunal Hearings or Mediation on behalf
of the owner, or as witness ($17.77 application fee applies); (f) Advertising and credit checks charged at cost; (g) Repairs and
maintenance incur a surcharge of 8.70%; (h) Allocation to specialist tenancy debt collectors as advised, accounting for costs and
tracking debt recoveries after tenancy end to be treated as money collected from the tenant. NOTE all charges are subject to
variations at one month’s notice. GST will be added to all fees, commissions, surcharges or other charges. If property is furnished
owner to supply chattel list prior to commencement date.
COLLECTION COSTS
If at the end of any tenancy there is debt owed by the owner to the agent, then the owner agrees that the
owner be liable for and pay for all costs of recovery of the debt, which costs shall be collected by a debt collection agency. Costs
payable by the owner shall include, legal fees, debt collection, commissions, fee’s and disbursements, and/or court filing fees and
disbursements.
SALE OF PROPERTY
The owner hereby informs Chic that the property, if currently available for sale shall be withdrawn upon
notification of a tenant signing up for the tenancy. In the event that the property is placed on the market for sale within the first
12 months of this agreement commencing, then a one off fee of $1,000+GST shall be payable to Chic. If you the owner places the
property on the market for sale without first advising Chic, we may elect at our discretion to treat the Management Agreement
at an end and to give notice immediately confirming that decision.
PERFORMANCE GUARANTEE
Chic agrees that should Chic fail to perform satisfactorily in any function to which this authority
applies the owner shall be entitled to 1 months free property management services.
CANCELLATION
The minimum term for which this authority applies is 1 month/s. If the authority is cancelled by the owner giving
notice before the minimum term from commencement date has elapsed the owner agrees to pay a fee of $500.00 plus GST.
